Effective Date: June 15, 2024

This Privacy Policy ("Policy") describes how SnapCache LLC ("SnapCache," "Company," "we," "us," or "our") collects, uses, stores, protects, and shares personal information and customer-provided media in connection with our website, www.snapcachellc.com, our physical location, and the digitization and professional services we provide.

By using our website, contacting SnapCache, or providing information or media to SnapCache, you acknowledge the practices described in this Policy.

1. Information We Collect

Personal Information

We may collect personal information that you voluntarily provide to us, including:

  • First and last name

  • Mailing or shipping address

  • Email address

  • Telephone number

  • Information submitted through quote requests, contact forms, advertising lead forms, or other communications

  • Information necessary to establish, manage, complete, and deliver an order

We may collect this information when you contact us, request a quote, place an order, communicate with us, visit our physical location, submit an online form, or otherwise request services.

Payment Information

When you purchase products or services, payment information may be collected and processed by third-party payment processors.

SnapCache LLC does not store full credit or debit card numbers. Payment processors may collect and retain payment information according to their applicable privacy and security practices.

Customer Media and Content

As a media digitization and professional services company, SnapCache may receive physical or digital materials from customers, including but not limited to:

  • Photographs and photo albums

  • Slides and negatives

  • Film

  • Videotapes

  • Audio tapes and recordings

  • CDs, DVDs, memory cards, and other digital storage media

  • Documents and records

  • Digital files

  • Other customer-provided materials

Collectively, these materials and the information contained within them are referred to in this Policy as "Customer Media."

Customer Media may contain personal, private, historical, financial, medical, legal, or other sensitive information concerning the customer or other individuals.

SnapCache treats the contents of Customer Media as confidential. Access is limited to SnapCache personnel and authorized service providers who reasonably require access to perform the requested service, provide technical or delivery functions, perform quality control, resolve service issues, or otherwise support the customer's order.

SnapCache does not sell Customer Media.

SnapCache does not publicly display or use Customer Media, including photographs, recordings, videos, documents, or other submitted content, for advertising, social media, promotional demonstrations, or unrelated purposes without authorization from the customer.

SnapCache does not claim ownership of Customer Media or intellectual-property rights in Customer Media solely because the material is submitted to SnapCache for digitization, restoration, processing, storage, or another requested service.

2. Customer Responsibility for Submitted Media

Customer Media may contain photographs, recordings, documents, copyrighted works, or personal information relating to individuals other than the customer.

By submitting Customer Media to SnapCache, the customer represents that they have the right or appropriate authority to possess the materials and authorize SnapCache to perform the requested services.

SnapCache does not independently verify ownership, copyright status, privacy rights, or consent of every individual appearing in or referenced by Customer Media.

Additional restrictions may apply to copyrighted, confidential, regulated, unlawful, or otherwise protected material.

3. How We Use Personal Information

SnapCache may use personal information to:

  • Provide and perform requested services

  • Prepare estimates and quotes

  • Establish and manage customer orders

  • Communicate about orders, projects, pickups, shipping, delivery, or service questions

  • Process payments and collect amounts due

  • Deliver completed digital files or physical media

  • Provide customer support

  • Maintain business, accounting, tax, and transaction records

  • Detect or prevent fraud, misuse, or security incidents

  • Improve our services, website, and customer experience

  • Provide information about SnapCache products, services, or promotions when permitted

  • Comply with applicable legal obligations

  • Exercise or defend legal rights

  • Carry out other purposes disclosed when information is collected

  • Carry out another purpose with the customer's consent

4. Artificial Intelligence and AI-Assisted Editing

SnapCache may use artificial intelligence ("AI") and AI-assisted editing tools as part of certain photo editing, enhancement, and restoration services.

Currently, SnapCache's use of AI with Customer Media is limited to AI-assisted tools available through Adobe software for purposes such as removing blemishes, repairing or restoring damaged portions of photographs, and performing similar customer-requested image-editing functions.

When these tools are used, photographs or portions of photographs may be processed using Adobe technologies as necessary to perform the requested editing or restoration service. Adobe's handling of information is governed by its applicable privacy, security, contractual, and data-processing terms.

SnapCache does not sell Customer Media to AI companies.

SnapCache does not intentionally submit or authorize Customer Media for the purpose of training publicly available or general-purpose artificial intelligence models.

SnapCache does not currently use AI as part of its standard digitization services to independently analyze, transcribe, summarize, identify, or generate narratives from customer audio recordings, videos, documents, or other Customer Media.

AI-assisted editing technologies may occasionally produce inaccurate or undesirable results. SnapCache reviews AI-assisted edits as appropriate before delivering completed work to the customer.

If SnapCache introduces additional AI-assisted services that materially change how Customer Media is processed, this Policy will be updated as appropriate. Specialized services involving additional AI processing or third-party providers may also be subject to separate disclosures, terms, or customer authorization.

Customers may contact SnapCache before authorizing a service if they have questions about whether AI-assisted processing will be involved.

5. Sharing Information With Service Providers

SnapCache does not sell, rent, or lease customer lists or personal information to third parties.

We may provide personal information or Customer Media to service providers when reasonably necessary to operate our business or provide a service requested by the customer.

These providers may include:

  • Payment processors

  • Website and hosting providers

  • Cloud-storage and file-delivery providers

  • Shipping and delivery providers

  • Email and communications providers

  • Analytics and advertising providers

  • Professional service providers

  • Technology providers necessary to perform an authorized service

Service providers receive information as reasonably necessary to perform their functions. Their handling of information may also be governed by their own applicable contractual, privacy, security, and data-processing terms.

SnapCache may disclose personal information when required by applicable law, legal process, court order, or governmental request, or when reasonably necessary to protect the rights, property, security, or safety of SnapCache, our customers, or others.

6. Cloud Storage and Digital Delivery

SnapCache may use third-party cloud-storage, hosting, backup, or file-delivery systems to store, process, transfer, or deliver customer files.

Digital delivery links may be subject to expiration, access controls, or other limitations.

Customers are responsible for downloading and maintaining their own backup copies of completed digital files after delivery.

Unless a customer has purchased or enrolled in a separate storage, archival, or subscription service, SnapCache should not be considered a permanent archival or backup service.

7. Customer Review and File Retention

Standard File Retention

Unless otherwise agreed, SnapCache retains digitized Customer Media and completed digital files for 90 days from the date the completed digital files are first made available to the customer.

The retention period provides time for customer delivery, review, corrections, recovery from delivery problems, and resolution of service issues.

After the 90-day retention period, SnapCache may permanently delete Customer Media, working files, and completed digital deliverables from active storage systems without further notice.

Customers are responsible for downloading, maintaining, and backing up completed digital files before the retention period expires.

Discovery Pricing Review Period

Customers using SnapCache's Discovery Pricing receive a 30-day review period to review their completed digital media and identify eligible items they do not wish to retain as part of their final order, subject to the terms of the Discovery Pricing service.

The 30-day Discovery Pricing review period is separate from SnapCache's 90-day file-retention period and does not extend the 90-day retention period unless otherwise agreed.

Removal of an item from a customer's final Discovery Pricing order does not necessarily result in immediate deletion of every temporary, working, cached, or backup copy of that item. Such copies may remain temporarily until removed through normal storage, backup, or system-maintenance processes.

Optional Extended Storage

SnapCache may offer optional extended storage, archival, or subscription services.

Files maintained under such a service may be retained according to the terms applicable to that service rather than the standard 90-day retention period.

Termination or expiration of an extended-storage service may be subject to separate retention, download, and deletion terms.

Backup Systems

Even after Customer Media has been deleted from active systems, residual copies may temporarily remain in backups, caches, recovery systems, or other technical infrastructure until overwritten or removed through normal system-retention processes.

8. Business Records

The 90-day Customer Media retention period applies to digitized Customer Media, working files, and digital deliverables. It does not require SnapCache to delete ordinary business records associated with an order.

SnapCache may retain information such as:

  • Customer name and contact information

  • Estimates and invoices

  • Payment and transaction records

  • Order history

  • Customer communications

  • Accounting and tax records

  • Service records reasonably necessary for business or legal purposes

Such records may be retained for as long as reasonably necessary to operate the business, maintain accurate records, comply with legal or tax obligations, resolve disputes, or exercise or defend legal rights.

9. Physical Customer Media

Physical Customer Media remains the customer's property unless otherwise agreed.

Original photographs, film, tapes, documents, storage devices, and other physical materials will generally be returned, shipped, picked up, or otherwise handled according to the customer's order arrangements and applicable service terms.

SnapCache will not intentionally destroy or dispose of original Customer Media solely because a customer requests deletion of personal information.

If a customer requests destruction or disposal of physical Customer Media, separate authorization may be required.

SnapCache takes reasonable precautions when handling Customer Media. However, privacy and data-security protections should not be interpreted as a guarantee against physical deterioration, pre-existing damage, media failure, or other risks inherent in handling aging, fragile, damaged, or obsolete media.

Shipping and transportation of physical Customer Media may involve third-party carriers. Although SnapCache takes reasonable precautions when preparing shipments, transportation by third-party carriers involves risks outside SnapCache's direct control.

Additional provisions concerning physical-media handling, abandoned property, shipping, damaged or deteriorating media, and other service-related matters may be contained in SnapCache's applicable service terms.

10. Customer Authorization for Marketing or Public Use

SnapCache does not use Customer Media for advertising, social media, public demonstrations, portfolio examples, before-and-after examples, or other promotional purposes without customer authorization.

When a customer authorizes such use, the authorization applies according to its terms.

A customer may contact SnapCache to withdraw authorization for future promotional use. Withdrawal will apply prospectively and may not require SnapCache to recall, destroy, or remove materials that were previously printed, distributed, published, or otherwise used in reliance on the customer's prior authorization where removal is impractical or no longer within SnapCache's control.

11. Website Analytics, Advertising, and Tracking

SnapCache may automatically collect information concerning how visitors interact with our website.

This information may include:

  • IP address

  • Browser type

  • Device information

  • Pages visited

  • Referring website or source

  • Access dates and times

  • Actions taken on the website

We may use analytics and advertising technologies, including Meta (Facebook) Pixel and related services, to understand website usage, measure advertising performance, improve our services, and deliver relevant advertising.

Information collected through these technologies may be processed by the applicable technology provider according to its privacy practices.

12. Advertising Lead Forms

SnapCache may collect personal information when individuals voluntarily submit lead forms through advertising platforms, including Facebook and Instagram.

Information may include a person's name, email address, telephone number, and other information voluntarily provided through the form.

SnapCache uses this information to respond to inquiries, prepare quotes, provide requested information, and communicate about products or services.

13. Cookies

Our website may use cookies and similar technologies to operate website features, remember preferences, understand website activity, and support analytics or advertising.

A cookie is a small data file stored on a user's device.

Users may manage, block, or delete cookies through their browser settings. Disabling certain cookies may affect the operation or functionality of portions of the website.

14. Security

SnapCache uses reasonable administrative, physical, and technical safeguards designed to protect personal information and Customer Media against unauthorized access, use, alteration, disclosure, or loss.

Access to Customer Media is limited to individuals and service providers who reasonably require access for authorized business or service purposes.

Our website uses encrypted connections, including SSL/TLS, where appropriate.

No physical storage system, electronic storage system, Internet transmission, wireless network, or security system can be guaranteed to be completely secure. Accordingly, SnapCache cannot guarantee the absolute security of personal information or Customer Media.

If SnapCache experiences a security incident involving personal information, we will provide notifications when required by applicable law.

15. Privacy Requests

Customers may contact SnapCache with questions or requests concerning personal information maintained by us, including reasonable requests to access, correct, or delete personal information.

SnapCache may take reasonable steps to verify the identity and authority of the person making a request before providing access to information or taking action.

We generally respond to verified privacy requests within 30 days.

SnapCache may retain information when reasonably necessary to:

  • Complete an existing transaction or service

  • Maintain accounting, tax, transaction, or business records

  • Detect or investigate security incidents, misuse, or fraud

  • Resolve disputes

  • Exercise or defend legal rights

  • Comply with applicable laws or legal obligations

Deletion from active systems may not immediately remove information from backups, caches, recovery systems, or other technical infrastructure. Such information may remain until removed through normal backup and retention processes.

A request to delete personal information does not constitute authorization to destroy physical Customer Media.

Nothing in this section is intended to limit any privacy rights that may be available to an individual under applicable law.

16. Children

SnapCache's website and services are not directed toward children under 13, and SnapCache does not knowingly collect personal information directly from children under 13 through the website.

Customer Media submitted by an adult may nevertheless contain photographs, video, audio, documents, or other information involving children. Such information is treated as Customer Media and processed as reasonably necessary to perform the service requested by the customer.

17. Email Communications

SnapCache may send customers emails concerning:

  • Quotes and inquiries

  • Orders and project status

  • Delivery

  • Transaction information

  • Customer service

  • Announcements

  • Surveys

  • Promotions or special offers

Marketing emails may include an unsubscribe mechanism. Customers may opt out of promotional email communications by following the unsubscribe instructions included in the message.

Opting out of promotional communications does not prevent SnapCache from sending transactional or service-related communications concerning an active order or customer relationship.

18. SMS and Mobile Messaging Privacy

Customers may provide a mobile telephone number and consent to receive text messages from SnapCache.

Consent may be obtained through our website, advertising lead forms, telephone communications, or in-person interactions when appropriate.

Mobile information and SMS opt-in consent will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

Information may be provided to telecommunications providers and service providers when necessary to transmit messages or operate our messaging services.

Consent to receive text messages is not a condition of purchase.

19. SMS Messaging Terms

Customers who opt in may receive messages concerning customer care, quotes, orders, appointments, pickups, deliveries, project updates, or other service-related matters.

Message frequency varies according to communication needs.

Message and data rates may apply.

Customers may reply STOP to unsubscribe from SMS messages at any time.

Customers may reply HELP for assistance.

Opting out of SMS communications does not prevent SnapCache from contacting a customer through other appropriate methods when reasonably necessary to complete or administer an existing transaction or service.

20. External Data Storage and Service Providers

SnapCache may store or process information using servers, cloud systems, software platforms, or other infrastructure operated by third-party vendors.

These providers may have access to information when reasonably necessary to perform services for SnapCache. Their handling of information is subject to applicable contractual arrangements, privacy policies, security practices, and legal requirements.

21. Business Transfers

If SnapCache is involved in a merger, acquisition, sale of assets, financing, restructuring, change of ownership, or similar business transaction, personal information and business records may be transferred as part of that transaction.

Any successor or acquiring entity receiving such information would be subject to applicable privacy and legal obligations concerning the transferred information.

22. Changes to This Privacy Policy

SnapCache may update this Policy periodically to reflect changes in our services, technology, business practices, or legal obligations.

When this Policy is updated, the revised version will be posted on our website and the "Last Updated" date will be changed accordingly.

Material changes may be communicated through additional means when appropriate or required by law.
